Welcome to ModeledMind. These Terms of Service ("Terms") govern your access to and use of the ModeledMind website, curriculum, and related services (collectively, the "Service") operated by ModeledMind ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

ModeledMind provides an educational curriculum about artificial intelligence, including written lessons, knowledge checks, and interactive tutoring features. The Service is provided for general educational purposes only.

2. Educational content — no professional advice

Content in the Service, including lesson material and responses generated by AI tutoring features, is provided for educational purposes and does not constitute professional, legal, financial, medical, or other specialist advice. You should not rely on the Service as a substitute for advice from a qualified professional.

3. AI-assisted content

Lessons are created with the assistance of artificial intelligence and reviewed by people before publication; they may still contain errors, omissions, or information that becomes outdated over time. Interactive tutoring features generate responses using AI in real time, and those responses can be inaccurate. We do not warrant the accuracy, completeness, or reliability of any content in the Service, and you use it at your own discretion.

4. Accounts and access

Certain features may require an access credential or account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under them. You agree to provide accurate information and to notify us promptly of any unauthorized use.

5. Acceptable use

• Do not use the Service in any way that violates applicable law.
• Do not attempt to gain unauthorized access to the Service, other users' data, or our systems.
• Do not scrape, resell, or redistribute the Service or its content without our written permission.
• Do not use the Service to generate or disseminate content that is unlawful, harmful, or infringes the rights of others.

6. Intellectual property

The Service, including its design, text, graphics, and other content (excluding content you submit), is owned by or licensed to ModeledMind and is protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes.

7. Fees

If any portion of the Service is offered for a fee, pricing and payment terms will be disclosed at the point of purchase. We may change pricing prospectively at any time.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODELEDMIND WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED DOLLARS (US $100), WHICHEVER IS GREATER.

10. Changes to the Service or these Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will post the updated Terms with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) will survive.

12. Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction.
